Hello, I would like to have a deferred PSO in my Consent Order. Is this possible? Can the PSO be future dated to mean it cannot be acted until a future date? This will mean I can get spousal maintenance until my PSO kicks in when I reach the appropriate age.

Do you mean the other party should get the whole pension and pay you SM then this reverts to a pension share on your retirement? Is this a pension that's already in payment?

We need a bit more information about the circumstances please.

Hello, yes thank you this is what I mean. Can we get a PSO as part of our consent order and I simply wait to send it to the pension company until I am age 50 when I can then claim it? Or is pension deferring done another way?
You were correct, I want to get spousal maintenance for three years and then enact the PSO if this is possible

Yes their pension is in payment and if we enact the PSO straight away he will lose the share straight and not have enough income to cover spousal maintenance so we want to do one thing at a time. Spousal maintenance now and then enact the PSO in three years but sort it all out now. Is that possible?

I am afraid spousal maintenance is by no means a given. It depends on your needs and his ability to pay.
You are expected to maximise your income through employment or claiming benefits before SM is considered.

If you took a share of the pension so long before normal retirement age the amount you'd get would be very much reduced. What kind of share is appropriate will depend on a number of factors including your ages, the length of the marriage (plus any cohabitation), whether there are dependent children and the assets you each have between you.

There are other ways to pay a portion of pension e.g. attachment orders but the disadvantage is that the arrangement ends on the death of the pension holder. pension sharing divided the fund into two separate and independent pensions.
