Hi,
As part of the Consent Order (financial remedy), my wife has been awarded a percentage of my current DB pension.

However it is now 6 months since the court case and she still has not instructed the pension to split !

Is there any way I can speed this process up, can I complain to the court or take any legal action? Is there a time limit ?

would welcome any advice.

Even though the court was supposed to action the pension split, and this was written into the consent order, nothing happened for around 6 months. My partner had to contact the pension company himself and sort it. A few months later it was all completed (and I think it was backdated to the value the pension was worth when he contacted them).
Tbh we felt let down by the his solicitor who didn't warn him that the court could happily leave it with no comeback.

The court makes a pension sharing order which the parties have to implement.
Has the order and pension sharing annex been sent to the pension scheme? You could do that. They have 4 months from the date of receipt to implement the share. If it is a internal share ie she gets her own pension within the scheme, it should be straightforward.

If an external share is required (funds going to a another pension set up/nominated by her) then she will need to provide details of the scheme. If she does not then you could find out how your pension scheme would approach the issue. If necessary it may be appropriate to ask the court for help to compel her to set up or nominate a scheme.
