Hi,

I posted in the England forum under the title 'will i get stung'

Thought i'd better check here as the laws seem to be different.

Anyway, the jist of the question is...

Just seperated, no kids, no house, married 5 years. No assets.

Moving to seperate rented accomodation.

She takes home 1200, I take home 3000, and we have both worked through the duration of the marriage. My debts are 18000, hers are 8000!

Am I likely to have to pay spousal maintenance?

Cheers for any advice guys.

In Scotland a husband has a duty to aliment his wife while she remains married to him. After divorce, periodical allowance (maintenance) may be awarded if payment of a capital sum is insufficient to satisfy the payee’s requirements, and if she has the need for continuing support. It is unlikely to be for more than three years from divorce unless there are exceptional circumstances, and no account is taken automatically of different earning capacities. In short there is much less likelihood of you having to maintain your wife after the divorce than if you were in England
