Solicitor Left UK and Operating on my Case Abroad!

Hi,

I did not envisage this scenario however my solicitor has left the country and is now operating outside of the EU on my divorce case! I was not made aware of this and only found out when I visited the office and quizzed the staff (who were not forthcoming).

Is this legal? Do I have any rights to change solicitor? Can I make a claim with the SRA on the conduct?

I am concerned as I currently progressing with the Child and Finance matters in my divorce.

It would have been nice to have been told the true position.

However, the solicitor is permitted to practice law in England & Wales if they hold a practising certificate from that law society. Your solicitor is essentially working remotely which is what a lot of solicitors I know do when they are dealing with urgent matters via phone/email when they are away from the office, abroad or otherwise.

As for your right to change solicitor - yes you have that right as the retainer you have with your solicitor can only be ended by you for no particular reason whereas your solicitor can only end that retainer with good reason.

If you are in receipt of legal aid that changes things somewhat as you need permission to change solicitor.
