I currently receive maintenance weekly off my ex, he has just informed me that as of July he will pay me monthly. Can he do this? As I am on benefit all of my benefit is paid weekly and I find this much easier to manage.

Is it a private agreement, a court order or via CSA?

Has his salary payments changed from weekly to monthly?

Its a private agreement nut it was part of the divorce if that makes sense. He is paid monthly it has been that way since we split up in Feb 2010

Has he given any reason for the change?

I haven't reminded myself of your situation (sorry) by looking at your previous posts - are you on talking terms?

He says he cant manage his money by paying me weekly but i have explained that my circumstances mean i am better if i receive the money weekly. He will do what suits him but i just wondered what my rights are. We are not on the best terms.

Mmmmmm - I think it depends if its written down somewhere official (Divorce Papers, Consent Order etc.) CM as £X per week or £X per month.

If it was agreed at £X per month, but he was paying you weekly at your request, I don't think you can do anything

Unfortunately it seems he can't manage his money by paying you weekly and you can't manage your money if he pays you monthly - there seems to be no compromise - as one of you is going to struggle :S

If it wasn't written down anywhere official and its a voluntary thing, I think as long as he pays CM, they don't put too much emphasis on whether its weekly or monthly.

Sorry I can't be more helpful.

I'm pretty sure it was part of the consent order as I remember reading somewhere that it was x per week. Thank you for your help.
