Welcome to Wikivorce.

In short nothing, providing there are two or more children - and a 16 week (approx) waiting period before being able to apply under the new CMS scheme.

Are you able to give us a bit more information please?

I''m on csa2 and the PWC has closed the case..the children are still both under 20. And I or the csa don''t know why she has closed it. I think maybe because I was on phasing working upwards rather than downwards, so the new system she will get a lot more money

That''s wrong if the PWC can do this, as all the nrp''s that are on for example csa1 and paying more than they would on csa2 aren''t allowed to close a case

Have you got a link anywhere that states waiting time is 16 weeks? As I can only find 13 weeks waiting time

Not to hand - I did say approx 16 weeks, so it wasn''t a definitive time frame.

If you call the child maintenance Options free helpline tomorrow (they are not connected with either the CSA or the new CMS) on 0800 988 0988, they will be able to give you more details. www.cmoptions.org

You could also open a case yourself. Which if it is within the waiting period will assessed on rules you were previously on.

Or at least that was the case with CS1 moving to CS2.

How old are children and how much difference are you looking at between CS2 and CS3?

The cms freephone number told me there is no waiting period

They can just close the csa2 and apply for a csa3 straight away

If I reopen I would be put onto the new rules now

I''m looking at a difference of £74 a week on new rules
The children are 15 and 18
