My boyfriend stays with me Friday to Sunday night with his 16 year old. He has his own registered address which he stays at weekdays without son.
The Mum is saying she has called csa and they have said son must be staying at dad registered address at weekends to qualify for the three night reduction ??? Can this be correct.

well it does seem strange. some weekend nights he stays with friends or grandparents.
surely it can''t be that he is only allowed to sleep at mums monday - thursday and dads weekends and never anywhere else.
my own children spend half their time with dad but they often stay with friends for parties which of course is all normal !!

we have been on csa website and worked out with his net weekly income and having son three nights he pays her £260 monthly. She is saying it is £350 per month or £610 per month if son stays here with Dad !!

Cant see the CSA being interested where the child stays each night. Just with which parent they are with.

Think the new gross scheme is in place now.

Oh dear. I was told on another thread that for one child on any applications made recently ie last week it was net income?

The regulations haven''t changed in this respect. child maintenance is deceased for shared care when the non resident parent cares for the child overnight and the NRP and child stay at the same address. See Reg 7(1) Child Support (Maintenance Calculations and Special Cases) Regulations 2000;

That means the NRP can provide care for the child away from the their home e.g. whilst on holiday or at another relative''s home. It would be different if the child is left in the care of someone else.

PS The new gross income came into effect on 25th November for all new applications.
