bfd222,

You are getting some of the key terms a bit muddled. "Separation Consent Order" is a mix of two different things.

- A "Separation Agreement" is the agreement that can be done before divorce but you cannot guarantee that it will not be contested and changed when the divorce is later settled.

- A "consent order" is the legally binding agreement that settles financial claims on divorce

- Some "consent orders" are drafted such that there is no ongoing spousal maintenance element, these consent orders are sometimes referred to as "Clean Breaks".

Thanks Wikivorce. I got the term “Separation Consent Order” from Managed Divorce when I spoke to them on the phone.

What propose does a “Separation Agreement” serve if it can be contested at a later date?

Are they expensive and do they take a long time?

Dont know to be honest as didnt go that route - I think they are used when the situation is more complicated, and there is money and asset transfers involved - if you decide to go with wikivorce though they should be able to explain your best options
