Some Advice Please On Easy DIY Divorce

Ok folks, has come to the time to get the divorce rolling.

Me and ex have spoken, and she has agreed to it on the grounds of unreasonable behaviour, so we can get it finished as quickly as possible and out the way, and I will cover the costs for all the stuff.

We have also agreed on the financial terms, where neither of us will make any claim against the others assests, and both will just walk away with what we have.

OK, so I understand I will need a Clean Break order, and to file the divorce petition - sooo....

is it easier to do this myself, or maybe use one of the online managed ones ? would be grateful for any members experience in this.

thankfully she is being good, and we arent going to argue over anything, just both feel it is better to do it amicabally and have a nice clean break and walk away from it.

It is a simple process to Petition for divorce, just get the necessary forms from your local family court (usually situated within the Crown court), fill in the form and take it back to the court with you marriage certificate and the fee (£300). If the Judge agrees the petition this will lead to the Decree-nisi being issued, 6 weeks and 1 day later you can apply for your Decree-absolute (costs £40) and that's it your divorced!
In between the Decree-nisi and the Decree-absolute you should sort out your finances by way of a Consent Order.
Whilst I self litigated through my divorce, I learned that there are times when you should get some paid legal advice, even if it is just for one hour. By doing this you can then say that the consent order was applied for having had the benefit of legal advice; encourage your wife to do the same.
There is a school of thought that once a consent order has been obtained then it cannot be challenged, however there have been cases where the consent order has been successfully challenged years later because one or the other partner will say that they had no legal advice prior to the consent order being made.
The above advice regarding getting a divorce is a very quick overview; if you decide to go for a DIY divorce and need any further help please ask.

Having said all that, there is a service advertised on wiki who will do everything for you, including the consent order for £359 (plus the costs of the applications). This could be the way to go if you can afford it and don't want the hassle of doing it yourself.

Thanks Leo, some good info there

I think I will look at the service you mention as would rather make sure everything is covered - even though I dont have any worries about her making future claims etc... will be nice for my own peace of mind, and also just less hassle for me

HI Peter.

I am also considering stopping the solicitors and doing that service and I just called them and they seem to know their stuff.

I have always thought that altough a divorce is about a grand that sols fees go on top. I might be wrong but this works out about the same and you know that's all you are going to pay.

We need a clean break too which I guess can be done afterwards but yes based on the conversation I had with them I would say that's the best option. It's like doing it yourself but with a solicitor to call on when you need them ( they do free phone support) but also cost effective. My stbx's solicitor said these online services were a con. but then she would as shes losing out financially!

Give them a ring before hand if you wish to. Like said above use these guys and you know the consent order has been done right so can't come back on you.

Thanks lost - have ordered the divorce + consent order with them this morning - even though its pretty straighforward in my case, is nice to know the advice is there if you need it, and that the consent order is all done properly so it isnt going to come back and bite you one day !

Hope yours goes smoothly too, fingers crossed we will be all done in a few months, both walk away with what we have now and no real hard feelings
