I,m hoping someone can answer me a quetion re above. What happens if you have a pension sharing order agreed in the divorce Consent Order but your solicitor has not set the order up and it is now over a year later? Is the pension sharing order invalid?

Hi Pinkfish - has your solicitor confirmed the Pension Sharing Order hasn't been set up?
Your solicitor should have completed a Form P1 - the Pension Sharing Annex - www.hmcourts-service.gov.uk/courtfinder/forms/form_p1_1205.pdf
In my case my solicitor sent a draft copy of P1 to me to do some of the answers and check addresses etc - then I sent it back to her and she sent it to court. After that the court drew up the Pension Sharing Order and sent that to the Pension Scheme with my Consent Order and Decree Absolute. After that the pension scheme wrote telling me I had to transfer my share out of their scheme and asking me where I wanted them to transfer it to.
Has nothing like that happened since you signed the Consent Order?

Hi Maggie,

Thanks for reply. No nothing has happened. Wrote to solicitor many times, no written answers from him. I don't even know the name of pension company, address or phone no. despite writing to sol and asking for it.

Also got endowment policies in joint names which have now matured and I can't get them because sol hasn't sent them paper work from court or done my name change thing. I just want this finished with instead of still having to deal with divorce stuff.

I'm worried about the pension and am considering making a complaint re solicitor.

Complain Pinkfish - in my experience it's the only way to get answers out of solicitors after they've closed your file. Ring them or email their office - ask for the name of the partner who deals with complaints - get his email address and tell him you've had no response to your questions about your pension share and this is now a complaint.Tell him the pension share in your Consent Order has not been implemented and ask if the proper procedure was followed.Ask about the solicitor's failures relating to your endowment policies. Theses are big money items and it sounds like cut and dried negligence - complain - it's the only way to find out what happened.

Thanks Maggie for your message. I know I will have to make a complaint, I didn't want to as I've had enough hassel during the past 3 years. Can't be avoided it seems.

Me too - I felt I had no alternative - when did you start asking questions ? I had my questions ignored for about 6 months - only when I complained did I get any response at all.
I listed my problems under the heading "My complaint is that my solicitor failed to ....."
It's the only way I've found to get information.

Hi Maggie, I started asking questions last Sept. I did get verbal answers which kept me at bay for a time. But I did keep writing and phoning. Guess I'm still learning not to be trusting and get some confidence to take action.

Complaint form done and now on its way.
