Im sure that Active8 will be along sometime to give you some advice. However the fact that he gets £711 a month at present would suggest that his pension is worth a lot more than he is making out. Accepting £10,000.00 and you would be selling yourself and your children short.

How many children do you have Lynn, and what are their ages? If you go on to the CSA website you can use the calculator to see how much maintenance he should be giving you.

This has to be done properly Lynn, you have your and your childrens future to think about and secure as best as you can.

Yes have a solicitor who has been trying to sort this for over a yr now not 100% convinced he knows exactly how the army side works as it seems to be quite complex. At first when i applied for divorce my ex refused to answer letters which held it up until my solicitor wrote and said he would get a court order. Then he got solicitor offered me 10k which i refused and now he has changed solicitors which will hold it up again thats why im choosing to go to court know. I have appointment with my solicitor on Thursday to discuss going to court.

I have 2 kids Marsa who are 13, 15 now.

Below is the link the the CSA Maintenance Calculator. This will give you an idea of how much you should be getting, however unless you know exactly how much income he has then you may not get a true figure.

Have you read back over the whole of this thread as there is lots of information and links to a Pension Benefits on Divorce booklet available to all three services. (I printed off a copy of this and gave it to my solicitor).

Im sure your solicitor will have dealt with Service Pensions, I suppose he cant do anything while the other side is stalling.

Hi again i did look at the maintenance calculator but i do not have a clue what he earns now since he left the army. Also read up on the leaflet u spoke about aswell which i will print off and take with me on thursday.

I read back over all the posts on here and applaud Dido for her "rant" as i know exactly how she feels as im sure lots of others on here do aswell.

What a truly interesting read! I have been searching the web for the past 18 months to get some 'inside' info. My burning question is how much is it costing you to go to court to secure the pension sharing Order. My ex has refused to disclose the CEV of his pension. My first Sol really didn't have a clue when it came to military pension scheme and I am still completely in the dark as to how this whole process works. I have a part time job and do not qualify for legal aid and am extremely anxious that I will not be able to pay the legal fees. I have two children and am currently in rented accommodation and just managing to make ends meet! I am in jeopardy of losing my right to a portion of his pension because I can't afford to go to court and fight for it! Please can someone out there shed some light on this??

H's pension is likely to be worth well in excess of £200K: that's as revalued, not necessarily CETV which as lots of posts on pension forums will explain is not a good valuer of Forces pensions. Some reading around this forum should give you lots of helpful background info.
£10K seems like a rather poor return for that!
Find a solicitor who is comfortable with pensions, and Govt pensions in particular. You may have to ring around a bit but it would be worth it.
if you go to www.resolution.org.uk they have a search facility (its for family law solicitors) and you can search by specialisations, including pensions.
You can also look at the BDM website (they advertise on this site): they can do a quick calculation for about £50 which can be a useful starting point.
