My husband applied for Decree Absolut without having Financial Settlement. Also he wants to remove my Registered matrimonial homes Right. My worrings are - I still live in his house. So can he obviously kick me out? What are my rights? Can I stay in this house or not? I dont know what to do? Scared and anxient...

hi catty,
he cant remove the home rights without a court order, just having the absolute wont work, the land registry will want the court order to remove it from the register, so dont worry.

You should do what I did: that is have your solicitors agree that the Absolut is NOT granted until the Financials are sorted.

Actually; that's standard practice. It doesn't mean that because he's applied; he'll get what he wants!

I've got the letter from his solicitor saying that my husband applied for Decree Absolut and he will make an Applikation to the Land Registry for removal Matrimonial Home right. It's not only words its his colicitors actions! He wants me to re-locate to rental accomodation. It's meen that he will get his Absolut and I have to leave this house?Can I refuse to-relocate? Is so, can he fisically kick me out by having his Absolut?

Not if you refuse it on grounds that the financial side is not sorted. But action is required from your side.

Am no expert but you sound so worried
A solicitors letter may seem scary but its not the law ,I think I would contact land registry to confirm your rights to stay in the house and then as sera did and ask your solicitor to step in and make sure DA cannot be given without finances sorted . You may be able to stay or maybe entitled to some sort of settlement , will depend on lots of different things, but cannot be decided without financial matters beeing properly sorted . am sure someone else here will jump in with further advice .
